General Terms and Conditions
These general terms and conditions apply to all services of Property Inspections (hereinafter: the “Service Provider”), a sole proprietorship established in Belgium, company number 1030635193, VAT number BE1030635193. By making an appointment, accepting a quotation or completing an online reservation, the client (hereinafter: the “Client”) declares to accept these terms and conditions.
Definitions
Service Provider: Property Inspections.
Client: the party requesting the service (tenant, landlord, real estate agent or third party).
Service: property condition report (check-in/check-out) and/or inspection service with report and photographic annex,
as agreed upon during reservation/quotation.
Independence and neutrality
Property Inspections acts as an independent and neutral third party. Findings are made objectively based on visible and verifiable elements at the time of inspection. The service is not “party advice” and does not represent unilateral interests.
Scope of the services
The report describes the condition of the property at the time of execution. The service does not include any technical, construction-related or legal expertise, unless expressly and explicitly agreed in writing.
The service does not include in any case:
- destructive or invasive examinations;
- measurements/inspections (moisture, stability, electricity, gas, water, ventilation, etc.);
- repairs, site supervision or material advice;
- interpretation of lease agreements or legal advice.
Execution of the appointment
- The Client ensures that the property is safe and accessible at the agreed time.
- The Client provides correct information in advance (address, property type, involved parties, contact details).
- If involved parties must be present (e.g. tenant/landlord), the Client ensures their availability.
Report & photographic annex
The report is generally delivered digitally within 48 hours after execution. Weekends and public holidays may affect the delivery time. The photographic annex serves as supporting material and does not constitute a complete photographic inventory.
Prices, costs and quotations
All prices are expressed in euros. If VAT is applicable, this is stated on the quotation/invoice. Additional costs (e.g. travel outside the standard region, extra rooms, waiting time, additional requests) are communicated in advance or charged according to the agreed rates.
Reservation, payment and invoicing
Online reservations: an appointment is only final after confirmation and payment (if online payment is offered). Payments are processed via a secure payment provider (e.g. Mollie).
Invoices: payable within 14 days, unless otherwise agreed. In case of non-payment, execution of the service may be suspended.
Cancellation and modification
In case of modification or cancellation, the following rules apply:
- More than 72 hours before the appointment: free modification or cancellation.
- Less than 72 hours before the appointment: a fee of 30% of the total amount will be charged.
- No-show / no access: if the Client (or involved party) is not present at the agreed time or access to the property is not possible, this is considered a late cancellation. In this case, no refund is due and a new appointment can only be scheduled after new payment.
Liability
Property Inspections is not liable for:
- incomplete or incorrect information received from the Client or third parties;
- defects that were not visible at the time of inspection;
- defects that arise after the inspection;
- use of the report outside the agreed context.
Liability is in all cases limited to the amount covered by the professional liability insurance, and can never exceed the amount paid by the Client for the relevant service.
Force majeure
In case of force majeure (illness, accident, unsafe situation, technical problems, extreme weather conditions, traffic issues or other unforeseen circumstances), the appointment may be rescheduled. If the service cannot be executed due to force majeure, any advance payment will be refunded.
Complaints
Complaints must be submitted in writing within 7 days after receipt of the report. After this period, the report is deemed accepted.
Consumers: right of withdrawal (services by appointment)
If the Client is a consumer and makes an online reservation for a service on a specific date/period, the right of withdrawal may be limited in accordance with consumer rules applicable to distance contracts. By reserving for a specific date/period, the Client accepts that execution takes place on the agreed date/period.
If the Client requests that execution starts before the end of the withdrawal period, compensation may be due for services already provided if withdrawal nevertheless occurs.
Applicable law and competent court
Belgian law applies exclusively. Any disputes fall under the jurisdiction of the courts of the district of Antwerp.
