What is a property inspection report?

A property inspection report is an official document that records the exact condition of a property when a tenant moves in or out. The document is prepared by an independent party and describes every room, wall, floor, ceiling, window, door, and installation. Photos are often added as supporting evidence.

Why is it important?

  1. Landlord protection: Prevents disputes about damage caused by the tenant.
  2. Tenant protection: Ensures they are not held responsible for pre-existing damage.
  3. Legal requirement: In Belgium, an inspection report must be drawn up at the start of every rental agreement and registered afterwards.
  4. Clarity and transparency: Both parties have a clear record of the property’s condition.

At move-in

A move-in report is drawn up to record the property’s condition before the tenant takes occupancy.

At move-out

When the tenant leaves, a move-out report is made and compared with the move-in version. Any damages or differences are identified objectively.

Legal framework

In Belgium, property inspection reports are legally required and must be contradictory, meaning both parties participate. Key points:

  1. Legal requirement: The Belgian Civil Code (BW) makes inspection reports mandatory for all rental agreements.
  2. Contradictory: This means that both tenant and landlord must have the opportunity to be present during the inspection and give feedback, which is essential for the legal validity of the document.
  3. Function: The report serves as proof of the property’s condition at the start of the lease and protects both parties against disputes about damages at the end of the tenancy.
